Pennsylvania law prohibits some DUI offenders from possessing firearms, but only people with three or more convictions within a 5-year period fall under the prohibition.
The primary restriction for gun ownership based upon s DUI conviction comes under Federal law at 18 U.S.C. § 922(g)(1). This law imposes lifelong firearm prohibition for certain misdemeanor convictions. Section 922(d)(1) also prohibits some people that are under indictment from purchasing a firearm. Both laws are invoked if the charge is a first degree misdemeanor in Pennsylvania or if the maximum sentence for the charge is more than two years.
